General Terms and Conditions

The following general terms and conditions (AGB) apply to all purchases or use of products and services provided by Gear 9 GmbH (hereinafter “Gear 9”). By placing an order, customers accept these terms and conditions.

1. Product and Service Offers

The product and service offers on the Gear 9 website are valid only while visible online and while stocks last, as confirmed in the order confirmation.

The images and descriptions on the website are for illustrative purposes. Gear 9 makes every effort to ensure accuracy but cannot guarantee that all descriptions are entirely free of errors. Minor deviations in appearance or functionality do not constitute grounds for claims.

2. Prices

All prices are listed in Swiss Francs (CHF) and include value-added tax (VAT). Additional fees, such as processing or shipping costs, are specified separately during the checkout process.

Gear 9 reserves the right to change prices at any time. However, the price applicable to an order is the price displayed at the time the order is placed and confirmed.

3. Conclusion of Contract

A contract is concluded when:

  1. The customer places an order and acknowledges these terms.

  2. Gear 9 accepts the order through an order confirmation.

  3. The product is shipped to the customer.

All orders are subject to payment receipt. If items are unavailable due to supplier issues, Gear 9 reserves the right to cancel the order and refund the payment.

Customers may request cancellation or changes to their orders before shipment. Gear 9 reserves the right to deny such requests if processing has already begun.

4. Shipping

Gear 9 ships only to addresses within Switzerland and Liechtenstein using Swiss Post during regular business hours. Shipping costs are displayed during checkout and included in the final price.

5. Payment Terms

Unless otherwise agreed, payments must be made immediately upon purchase via credit card or Twint.

All electronic payment transactions are processed securely. Gear 9 complies with applicable data protection laws to safeguard customer information.

6. Returns and Complaints

  • Warranty Claims:
    Gear 9 offers a two-year warranty for defects in materials and workmanship, as required under Swiss law (Art. 210 OR). This warranty does not cover damage resulting from:

    1. Normal wear and tear.

    2. Misuse, improper handling, or failure to follow the product’s care instructions.

    3. Alteration or unauthorized repair by the customer.

Customers must report warranty claims to office@gear9.ch within 14 days of discovering the defect. Products must be returned only after approval by Gear 9 customer service. Gear 9 will bear the return shipping costs for valid warranty claims.

  • Voluntary Returns:
    Items ordered incorrectly may be returned only in unopened, original packaging. The customer is responsible for return shipping costs in such cases.

All complaints must be reported within 14 days of receiving the product by email to office@gear9.ch.

7. Governing Law and Jurisdiction

This contract is governed by Swiss law. The exclusive place of jurisdiction is Zurich, subject to mandatory consumer protection laws that may allow customers to bring claims in their place of residence.

8. Modifications to the Terms

Gear 9 reserves the right to amend these terms and conditions at any time. Changes apply only to future orders and must be made in writing.
